Privacy Policy

MidSchoolMath is an organization created to serve and support middle school math students and teachers. We value the trust you have placed in us to create quality educational content for students and children. All components and elements of Core Curriculum by MidSchoolMath, including tools, applications, games and dashboards accessed via midschoolmath.com (collectively referred to as the “system”), have been developed to create new levels of student engagement and learning.

To achieve these goals, we must collect information about our users and their use of our services.  The following Privacy Policy (“Privacy Policy” or “Policy”, which is part of the Terms of Use (“Terms”) describes how MidSchoolMath (“MidSchoolMath” or “we”) collects, protects, uses and shares information that is gathered through the use of our website and system, including Student Data.

This Privacy Policy communicates our practices to parents, teachers, and schools and school district administrators, collectively “you,” who license our products and services for either your own use or the use of your students.  By continuing to interact with the MidSchoolMath system, you agree to the practices described in this Privacy Policy on behalf of yourself and your students.

It important to MidSchoolMath to create a safe and trustworthy environment for all users. MidSchoolMath recognizes that you care about how your information and the information of your students is used. While we encourage you to review this Policy in full, we would like to highlight the following elements: 

  • We DO NOT and WILL NEVER sell or share student data with third parties for the purposes of targeted advertising or development of marketing profiles

  • We DO NOT and WILL NEVER claim ownership of student data

Policy Overview

When you visit our website, or use our system, MidSchoolMath may collect and use certain information about you and your students so that the system can operate as intended, for educational purposes. This policy applies to midschoolmath.com and all associated domains and subdomains, software and apps, covering all information collected in connection with access and use of the MidSchoolMath system. This Privacy Policy applies whether access or use of the digital properties is via personal computer, mobile device, or otherwise and to interactive features owned and operated by MidSchoolMath that are available through the system. Users of the MidSchoolMath system fall into one of the following categories: (1) Teachers or administrators of a school or school district (collectively, “Educators”) and (2) Students (collectively, “Students”)  

Note: The MidSchoolMath system contains teaching and learning resources designed for grades 5, 6, 7 and 8. Therefore, students may be under the age of 13 or under the age of 18. Students may access the system only after their teacher or school or school district administrator has entered into a license with MidSchoolMath and has provided the students with access. This policy outlines our use of student data for students of all ages and therefore also serves as our Children’s Privacy Policy. 

1. Family Educational Rights and Privacy Act (FERPA)

MidSchoolMath services comply with all applicable provisions of the Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99). We receive Student Data from Customers who are educational institutions as a "school official" under FERPA. MidSchoolMath only handles and processes Student Data for educational purposes. In the event we receive a subpoena or judicial order for the disclosure of education records, we will notify the associated institutional Customer(s) prior to fulfilling the request in accordance with FERPA. 2. Children’s Online Privacy Protection Act (COPPA)

MidSchoolMath services comply with all applicable provisions of the Children's Online Privacy Protection Act (COPPA) (15 USC 6501 et seq.) To the extent COPPA applies to information we collect, MidSchoolMath handles and processes such information for educational purposes only, at the direction of the partnering Customer. 3. California Consumer Protection Act (CCPA)

MidSchoolMath services comply with all applicable provisions of the California Consumer Protection Act (CCPA) (§1798.100 et seq.) The information we collect is solely for the delivery of our educational services and is not sold to any third parties for direct marketing purposes. All Personally Identifiable Information (PII) we have about our customers is accurate and necessary to provide our Services.

4. Information Collected by MidSchoolMath and Why 

MidSchoolMath collects information about Users in multiple ways, including Personal Information provided directly to us by Educational Institutions for upload to the Service, data collected directly from or generated by Student and Educator Users of the Service, and data generated through your use of the Service. Depending on the Services provided, we may also collect Personal Information through other methods that follow the terms of this Privacy Policy.

We may automatically collect information about the devices you use to interact with our digital properties and how you interact with our digital properties. The information collected may include your IP addresses, device identifiers, web browser types and versions, approximate locations based on IP addresses, search terms and results within the system, date, time, and pages viewed, and your languages.

The MidSchoolMath system does not collect personal information about your online activities across third-party websites or online services.  Therefore, “do not track” signals transmitted from web browsers do not apply to our system, and we do not alter any of our data collection and use practices upon receipt of such a signal.

When you use our digital properties, MidSchoolMath may store data in “cookies,” or similar technology on your devices.  This is used collect information about how you use our digital properties. Certain browsers may allow you to disable cookies.  However, disabling cookies from MidSchoolMath may limit use of certain features and system functionality. 

MidSchoolMath.com provides information about our products, services, and resources for teachers, school leaders and school district administrators who are not licensed users of the MidSchoolMath system. Information collected through from non-licensed users on this site includes, but is not limited to: name, email address, job title, school name, school district name, phone, and areas of service interested in. We do not sell or share information collected in this manner with any third party or outside organization. 

Subdomains of midschoolmath.com provide direct access to these products, services, and resources (the System) for all paid and unpaid authorized system users (educators and students). This includes licensed users and those granted system access for trial or demonstration purposes. To provide system access, MidSchoolMath creates secure, password protected accounts using information provided to us by your educational institution. Data handling practices and security measures are outlined in detail in the Terms of Use. 

For Educators, data that is collected or can be added to the system includes: name, email address, additional contact information, job title, district/teacher ID, grades and/or courses taught, school name and location, and an avatar that may be a photo or representational image.  

For students, data that is collected or can be added to the system includes: name, grade, school name and location, classes/courses/sections enrolled in, district or student ID, and an avatar that may be a photo or representational image. We do not ask for student email addresses.   

Use of the MidSchoolMath system generates information and data that may be tied back to specific users as part of its functionality, to enable features such as progress monitoring, feedback and assessment. This information includes: responses on exercises, activities and assessments; scores and grades; chats; creative works; progress in activities, assignments and games; notes and annotations; questions and comments (from students to educators); feedback, questions, comments and feedback (from educators to students) and more.   

MidSchoolMath has policies and procedures in place to safeguard information collected, as outlined in the Terms of Use. It is the responsibility of all users to safeguard their password and not share user credentials. 

5. What MidSchoolMath does - and does not do - with Collected Information 

Personal information is collected to provide educators and students access to the system at the request of their educational institution that has purchased a license to use the system (or initiated a free trial of the system) for educational purposes. This information is used to manage administration of the system, such as customer communications and support requests.   

Information generated through system use, such as answers, responses and scores, drives system functionality for educational purposes, enabling features such as progress monitoring, feedback and assessment, and delivery of tutorials and assignments. This data, along with logs generated through normal system operation, may also be used to monitor system health, ensure appropriate scaling of computing resources and detect unauthorized access or fraudulent activity. 

In order to provide Educators high-quality services, and offer Educators access to MidSchoolMath products and services, MidSchoolMath may utilize educator email addresses and other information for direct communications. Directions to unsubscribe from any promotional communications can be found in the footer of all such communications. 

  • MidSchoolMath does not permit third-party ad networks or similar services to collect personal information of student or educator users within the system.

  • MidSchoolMath does not permit students, including children under the age of 13, to make personal information publicly available outside of the system. 

  • MidSchoolMath does not sell or trade the names, emails or other and personal information collected on students with any third party or outside organization for third party marketing, market profiling or advertisement.  

  • MidSchoolMath does not sell, share or trade the names, emails or other personal information collected on educators with any third party or outside organization for third party marketing, market profiling or advertisement. 

  • MidSchoolMath does not claim ownership of student data.    

  • MidSchoolMath does not market to students.  

MidSchoolMath does not collect personal information or contact information for student parents and guardians. Therefore, MidSchoolMath relies on educational institutions and educator users to provide students with access information. All data provided to teachers is available through the student portal, and while parents and guardians are welcome to view this data with their student, MidSchoolMath cannot provide parents or guardians with student account access or account information. Parents and guardians may contact their educational institution ask to review the personal information collected and retained by MidSchoolMath about a particular student, as well as request its deletion. 

6. Use of Data for Research

MidSchoolMath may use de-identified and aggregate data about system use for academic research, product improvement, field testing new content, and other purposes. To de-identify data, MidSchoolMath removes all direct and indirect personal identifiers, including but not limited include, name, ID number, teacher name, class and school identifications. MidSchoolMath will not attempt to re-identify de-identified data (unless required to do so by law) and will not transfer de-identified data to a third party unless they also agree not to attempt re-identification. We may store de-identified data indefinitely.

MidSchoolMath may partner with third-party researchers to conduct such research or use an internal research team. If the research is not exempt from IRB review, an Institutional Review Board (IRB) will review the goals and procedures of the study, including those related to maintaining privacy of information.

In connection with research studies, MidSchoolMath and/or its research partners may publish or discuss aggregate data about student performance and results. Individual schools and districts may work with MidSchoolMath as partners on targeted research studies in which data use will be guided by a Memorandum of Understanding.  

7. Data Retention

Upon conclusion of contracts and/or trial accounts, MidSchoolMath will securely archive data for a minimum of two years. Educational institutions may request a copy of their data by emailing their request to info@midschoolmath.com within 90 days upon conclusion of their contract or trial account. Educational institutions may request that all data be deleted instead of being archived by emailing a written request to info@midschoolmath.com within 90 days upon conclusion of their contract or trial account. 

8. Additional Instances of Data Sharing 

Subcontractors:  MidSchoolMath may occasionally hire subcontractors, vendors or other third parties to help deliver or improve the Service. All third parties that may have access to personal information or data are subject to privacy and security contractual requirements equivalent to those set forth in this Policy.

Access Requests: Educational institutions have primary responsibility for fulfilling student and parent access, amendment, and export requests. In most cases, Customers can fulfill these requests using the built-in functionality of the Service. Where this functionality is not available or the Customer cannot otherwise fulfill the request on their own, we will provide reasonable assistance with the production or export of Student Data if the assistance is in accordance with our Agreement and applicable law. In rare cases, we may not be able to fully satisfy these requests. Examples include requests for confidential company information in addition to Student Data, requests for Student Data in a specific or proprietary format that we are unable to support, or requests that are prohibited by law.

Legal and Safety Uses: MidSchoolMath may use and disclose personal information and data in unique instances when it is required by law, such as to comply with a subpoena, court order or similar legal process, to protect or exercise our legal rights, to defend against claims, to investigate fraud and other criminal conduct, to enforce our Terms of Service, to respond to a government request, to protect the security, integrity and availability of the Service, or to otherwise protect the property and safety of the Company, our Users, and others.

Transfer of Assets: If in the future, MidSchoolMath is involved in a merger, acquisition, or sale of all or a portion of our assets, user information and data may be transferred as part of the transaction to an assignee or new entity. We will condition any merger, acquisition, or sale on continued adherence to the terms of this Policy and maintaining a materially similar level of protection for your Personal Information. If such an event occurs, we will provide you information about the coming change, how it may impact you and any choices you may have.

9. Policy Updates and Revisions

MidSchoolMath may revise and update this privacy policy to reflect changes in the law, our practices or system features. We ask that users and educational institutions periodically review this policy to be sure you are familiar with the most current version, as noted below. Non-material changes will be effective immediately upon posting. 

If we make material changes to this Privacy Policy that increase MidSchoolMath’s rights to use personal information we have previously collected about you, we will obtain your consent for those changes, as they relate both to your information, and to your students’ information, either through an email to your registered email address, or by prominent posting within the system. If such changes occur, you will be asked to consent to these changes before continuing use of the system.
